Effective Date: March 1, 2026 Welcome to Viya ("Viya," "we," "us," or "our").

By accessing or using www.goviya.ai (the "Site") and any related services (collectively, the "Services"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

If you do not agree to these Terms, do not access or use the Site or Services.

1. Nature of Service / Informational Purposes Only

Viya provides personalized travel recommendations and curated port-day planning guidance for informational and planning purposes only. Viya does not book travel, process payments for excursions, arrange transportation, or act as a travel agency.

All bookings are made directly between you and third-party providers. Viya has no involvement in, and accepts no responsibility for, those transactions.

Viya's recommendations may be generated or assisted by artificial intelligence. While we review content for quality, AI-assisted systems may produce inaccuracies, omissions, or outdated information. All time-sensitive or critical information — including but not limited to ship arrival times, all-aboard deadlines, port logistics, vendor availability, pricing, operating hours, safety conditions, and local regulations — must be independently verified through your cruise line's official app, booking confirmation, or directly with service providers prior to travel.

You are solely responsible for verifying all details before making any travel decisions. Your use of this Service constitutes your acknowledgment of this limitation.

2. Eligibility

You must be at least 18 years of age to use this Site and purchase Services. By using the Site, you represent and warrant that you meet this requirement. Viya does not knowingly collect information from or provide services to individuals under the age of 18.

3. No Travel Agency Relationship

Viya is not a licensed travel agency and does not sell, arrange, manage, or guarantee travel services of any kind. We do not guarantee the performance, safety, availability, legality, or pricing of any third-party excursion, operator, platform, or service.

No partnership, joint venture, agency, franchise, or employment relationship is created between you and Viya through your use of the Site or Services.

4. Third-Party Providers

All services, tours, transportation, and experiences referenced on the Site are provided by independent third parties over whom Viya exercises no control. Viya is not responsible for cancellations, delays, schedule changes, injuries, losses, damages, service failures, or any other issues arising from third-party services.

Any agreement you enter into with a third-party provider is solely between you and that provider. We encourage you to review the terms, cancellation policies, and safety information of any third party before booking.

5. Assumption of Risk

Travel and excursion activities involve inherent and significant risks, including but not limited to weather disruptions, transportation delays, vendor cancellations, port changes, physical activity risks, political conditions, public health events, and local safety considerations.

By using Viya's Services, you acknowledge that you are voluntarily choosing to engage in travel-related activities, that you have been informed of potential risks, and that you assume full and sole responsibility for your decisions and all associated risks. Viya expressly disclaims any duty to warn beyond the general disclosures contained in these Terms.

6. No Guarantees

Viya strives to provide thoughtful, personalized travel recommendations, but makes no warranties — express, implied, or statutory — regarding specific outcomes, vendor availability, pricing accuracy, weather conditions, transportation reliability, or satisfaction with any recommended activity.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. VIYA EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Travel involves inherent uncertainty. All decisions made based on Viya's recommendations are made at your own discretion and risk.

7. Purchases and Refund Policy

All purchases of Viya reports and Services are final at the time of delivery. Due to the personalized and time-intensive nature of Viya's reports, we do not offer refunds except as described below.

If you believe your report materially fails to address the preferences submitted in your intake form, you must contact us at hello@goviya.ai within 7 days of delivery with a written explanation of the specific discrepancy. Viya will, at its sole discretion, offer one reasonable revision based on your original intake submission. A revision does not constitute a refund and does not extend the 7-day window.

Viya reserves the right to decline revision requests that are based on changed preferences, general dissatisfaction, or matters outside the scope of the original submission.

8. Affiliate Disclosure

Some links or recommendations on the Site may be affiliate links, meaning Viya may earn a commission if you book or purchase through those links, at no additional cost to you. Affiliate relationships do not influence the editorial integrity of our recommendations. Viya only recommends services we believe may be genuinely useful to travelers.

Affiliate links will be identified where required by applicable law, including FTC guidelines.

9. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, report content, and AI-generated recommendations, is the property of Viya or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or commercially exploit any content from the Site without prior written permission from Viya.

Your purchase of a report grants you a limited, non-exclusive, non-transferable license to use that report for your own personal, non-commercial travel planning purposes only.

10. Prohibited Use

You agree not to use the Site or Services to:

  • Violate any applicable local, state, national, or international law or regulation

  • Resell, sublicense, or commercially exploit any report or content generated by Viya

  • Submit false, misleading, or fraudulent intake information

  • Attempt to reverse-engineer, scrape, or otherwise extract proprietary data or systems from the Site

  • Engage in any conduct that disrupts or interferes with the operation of the Site

Viya reserves the right to refuse service, cancel orders, or terminate access for any user who violates these Terms, at our sole discretion and without refund.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VIYA AND ITS OWNER, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF ENJOYMENT, MISSED DEPARTURES, FINANCIAL LOSS, PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSSES — ARISING FROM YOUR USE OF THE SITE OR RELIANCE ON ANY RECOMMENDATIONS PROVIDED, EVEN IF VIYA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR COULD HAVE FORESEEN SUCH DAMAGES.

IN NO EVENT SHALL VIYA'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU ACTUALLY PAID TO VIYA FOR THE SPECIFIC REPORT OR SERVICE GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, VIYA'S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Viya and its owner, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your reliance on any recommendation or content provided by Viya; or (d) your interactions with any third-party provider including any claims brought by third parties arising from your conduct.

13. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

CLASS ACTION WAIVER: You agree that any arbitration or legal proceeding shall be conducted on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm. Nothing in this section shall prevent Viya from pursuing collection of amounts owed through appropriate legal channels.

You may opt out of this arbitration agreement by sending written notice to hello@goviya.ai within 30 days of first using the Services.

14. Force Majeure

Viya shall not be held liable for any delay, disruption, cancellation, or failure in performance resulting from circumstances beyond our reasonable control, including but not limited to weather events, natural disasters, port changes, government actions, labor disputes, transportation interruptions, vendor closures, public health events, or other unforeseeable circumstances.

15. Modifications to Terms

Viya reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference and available at [Privacy Policy]. By using the Site, you consent to the data practices described therein.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Ohio.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Viya regarding your use of the Site and Services, and supersede any prior agreements or understandings.
